Práce se zabývá problematikou alternativních trestů. Nejprve popisuje pojem a účel trestu, zásady ukládání trestů a koncept restorativní justice. Následně pak přibližuje jednotlivé druhy alternativních trestů a opatření, hmotněprávních alternativ k potrestání a procesních alternativ. Dále rozebírá alternativní trest domácího vězení, realizaci tohoto trestu u našich sousedních států ? Slovenska, Rakouska, Polska, Německa a realizaci v České republice. Vysvětluje podstatu probace a mediace, popisuje vznik Probační a mediační služby u nás a činnost této služby v rámci alternativního trestu domácího vězení. Objasňuje pojem a význam resocializace a reintegrace, dále pro koho jsou určeny resocializační a reintegrační programy a některé z nich blíže popisuje. Jejím cílem je zjistit využívání trestu domácího vězení v resocializační praxi v České republice. |

The thesis deals with the issue of alternative punishments. The first describes the concept and purpose of punishment, the principles of sentencing and the concept of restorative justice. Subsequently then close individual types of alternative punishments and measures, legal alternatives to punishment and procedural alternatives. Further discusses an alternative punishment of the house arrest, the implementation of this punishment in our neighbouring countries ? Slovakia, Austria, Poland, Germany, and implementation with us. Explains the essence of the of probation and mediation, describes the emergence of the Probation and mediation service in the Czech Republic and the activity of this service in the framework of an alternative punishment of the house arrest. Explains the concept and the importance of resocialization and reintegration, further for whom they are intended resocialization and reintegration programs, and some of them closer describes. The aim of thesis is find the use of punishment of the house arrest in resocialization practice in the Czech Republic. |
